Monthly Salary: Commensurate with experience Job Posting Number: 1113 Opening Date: 09/08/2017 Closing Date: Open until closed Number of Openings: 1 Essential Functions: Performs advanced professional legal transactional work that involves regular contact with the Executive Director, Deputy Executive Director and General Counsel and various division directors of the Employees Retirement System of Texas, as well as with legal staffs of insurance companies, third party administrators, benefit providers, pharmacy benefit managers, actuaries, health maintenance organizations and other entities with whom ERS contracts. May specialize in one or more areas of ERS operations. Works under the general direction of the Deputy Executive Director and General Counsel with extensive latitude for the use of initiative and independent judgment. Prepares, reviews, drafts and/or negotiates a variety of complex contracts, including health care or insurance-related contracts, documents, opinions, briefs, ERS rules and insurance bid specifications as well as other legal documents, including Requests for Proposals. May draft and negotiate provider or managed care contracts related to health care providers within the Group Benefits Program. Should have an interest in developing expertise in the areas of federal and state laws and regulations regarding the Affordable Care Act; health care compliance (including HIPAA, HiTech, COBRA, Stark and anti-kickback; privacy; fraud, waste and abuse and related issues), Texas HMO, PPO, POS, Medicare Advantage, accountable care organizations and medical home health care delivery models for health plans. May also draft, interpret, review and negotiate contracts and other legal documents, including information technology and vendor contracts, purchase requisitions, bid specifications, purchase orders, etc., involving programs administered by the retirement system. May also develop requirements, specifications and contracts for projects and/or contracted staff, including drafting and reviewing solicitation documents, participating in the review of responses to solicitations and advising on procurement-related concerns. Interprets laws and regulations, with an emphasis on health care, insurance-related, and employee benefits matters. Gives legal advice. Must be a self-starter with a willingness to seek out opportunities. Drafts bills for legislative consideration and reviews pending legislation. May participate in complex insurance-related administrative hearings and issues as needed. Assists in developing and writing ERS procedure manuals and administrative directives. May provide training to ERS staff as requested. Required Minimum Qualifications: Your application for employment must reflect how you meet each of the following minimum qualifications: 1) Graduation from an accredited law school with a juris doctorate degree and license to practice law in the State of Texas and is an active member in good standing with the State Bar of Texas. 2) Four (4) years of experience in the practice of law. 3) Experience: drafting, negotiating and reviewing complex contracts; analyzing and solving complex legal problems; interpreting state and federal laws and regulations. 4) A strong background in legal research and writing, preferably in the area of health care law, corporate, and/or insurance law.
